1. Acceptance of Terms
By accessing or using the services provided by ASD Life Coaches ("we," "us," or "our"), including our website at asdlifecoaches.com and all related coaching services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
We reserve the right to modify these Terms at any time. Continued use of our services after any modifications constitutes acceptance of the updated Terms. We will notify users of material changes via email or prominent website notice.
2. Description of Services
ASD Life Coaches provides cognitive life coaching services for autistic adults and their families. Our services include but are not limited to:
- One-on-one virtual and in-person coaching sessions
- Executive functioning skill development
- Social skills and relationship coaching
- Career and employment support
- Independent living skills training
- Educational resources and workshops
Important: Our coaching services are not therapy, counseling, or medical treatment. We do not diagnose, treat, or cure any mental health conditions. Coaching is a collaborative partnership focused on practical skill-building and goal achievement.
3. User Responsibilities
As a user of our services, you agree to:
- Provide accurate and complete information during registration and booking
- Maintain the confidentiality of any account credentials
- Attend scheduled sessions or provide at least 24 hours notice for cancellations
- Engage respectfully with coaches and staff
- Not use our services for any unlawful purpose
- Not share, redistribute, or resell coaching materials without authorization
4. Payment and Refund Policy
Pricing: Virtual coaching sessions are $180 per session. In-person sessions are $225 per session. Initial consultations (30 minutes) are free.
Payment: Payment is due at the time of booking or as agreed upon in writing. We accept major credit cards, debit cards, and approved funding sources (NJ DDD, ClassWallet, California SDP).
Cancellations: Sessions cancelled with less than 24 hours notice may be subject to a cancellation fee equal to 50% of the session cost. No-shows may be charged the full session fee.
Refunds: Refund requests must be submitted within 7 days of the session. Refunds are issued at our discretion and may be provided as service credits.
5. Intellectual Property
All content on our website and in our coaching materials, including text, graphics, logos, images, videos, and software, is the property of ASD Life Coaches or its content suppliers and is protected by United States and international copyright laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our materials without prior written consent, except for personal, non-commercial use.
6. Confidentiality
We maintain strict confidentiality regarding all client information shared during coaching sessions. Information may only be disclosed:
- With your express written consent
- When required by law or court order
- To prevent imminent harm to yourself or others
- In cases of suspected abuse or neglect as required by mandatory reporting laws
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASD LIFE COACHES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use our services
- Any conduct or content of any third party on our services
- Any content obtained from our services
- Unauthorized access, use, or alteration of your transmissions or content
Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount paid by you for services in the twelve (12) months preceding the claim.
8. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that our services will meet your specific requirements, be uninterrupted, timely, secure, or error-free, or that any results obtained from the use of our services will be accurate or reliable.
9. Notice and Cure Policy
Mandatory Pre-Dispute Resolution: Before initiating any legal action, claim, or proceeding against ASD Life Coaches, you must first provide us with written notice of the alleged breach, violation, or dispute ("Notice").
Notice Requirements:
- Notice must be sent via email to [email protected] AND via certified mail to our business address
- Notice must include: your name, contact information, detailed description of the alleged issue, and your proposed resolution
- Notice must be dated and signed
Cure Period:
Upon receipt of valid Notice, ASD Life Coaches shall have sixty (60) days to cure or address the alleged breach or issue ("Cure Period"). During this Cure Period, you agree not to initiate any legal proceedings.
Good Faith Negotiation:
During the Cure Period, both parties agree to engage in good faith negotiations to resolve the dispute. This may include phone calls, video conferences, or written correspondence.
Extension:
The Cure Period may be extended by mutual written agreement if additional time is needed to fully address the issue.
10. Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
Arbitration: After completion of the Notice and Cure process, any remaining disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Monmouth County, New Jersey, or via video conference at the claimant's election.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Small Claims Exception: Either party may bring qualifying claims in small claims court.
11. Indemnification
You agree to indemnify, defend, and hold harmless ASD Life Coaches, its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.
12. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and Accessibility Statement, constitute the entire agreement between you and ASD Life Coaches regarding the use of our services and supersede all prior agreements and understandings.
